Terms of service
Who we are and these terms
These terms apply when you use https://kellykanine.com (the "site"). The site is operated by Katie Kelly, trading as KellyKanine, of 82 Rashierigg Place, Longridge, Bathgate EH47 8AT.
Contact: contact@kellykanine.com.
By using the site you accept these terms. If you are a consumer, nothing in these terms affects your statutory rights.
Acceptable use
You agree to:
- use the site only for lawful purposes
- not attempt to gain unauthorised access to the site, the server it is hosted on, or any connected system, or to interfere with or disrupt them (such acts are offences under the Computer Misuse Act 1990)
- not introduce viruses or other malicious or technologically harmful material
- not misuse any forms (for example to send spam or bulk unsolicited messages)
- not systematically copy or scrape content from the site for reuse
Content and intellectual property
Unless stated otherwise, we (or our licensors) own the content on this site: text, images, logos and code. You may view, download and print pages for your own use; you must not otherwise reproduce or reuse content without our written permission.
Information on this site
The content of this site is provided for general information. We keep it updated with reasonable care but do not guarantee it is complete or free of errors, and it may change at any time without notice.
Site availability
We aim to keep the site available but do not guarantee uninterrupted access. We may suspend, withdraw or restrict all or part of the site for business or operational reasons.
Links to other sites
Where the site links to third-party sites, those links are provided for information only. We have no control over their content and do not endorse them.
Content from Google Maps
This site shows reviews and other content from Google Maps. Your use of that content is subject to the Google Maps/Google Earth Additional Terms of Service (maps.google.com/help/terms_maps) and the Google Privacy Policy (policies.google.com/privacy).
Our store platform (Shopify)
This store runs on Shopify, which provides the platform, hosting and checkout that let us offer the site to you. Everything you buy here you buy from us, not from Shopify: we are the seller, and we are responsible to you for the products, the services and these terms.
Shopify is not a party to the contract between you and us and is not responsible for the goods or services we supply. Your use of the store is also subject to Shopify's own terms as the platform operator.
Nothing in this section affects your statutory rights against us as the seller, or our obligations to you under these terms.
Ordering from us
We sell services through the site. Your order is an offer to buy; a contract is formed when we confirm acceptance (for goods, at the latest when we dispatch them). We may decline an order, for example where something is unavailable or mispriced, and will refund any payment already made.
Returns, cancellations and refunds are dealt with in our refund policy.
Prices and payment
Prices are in pounds sterling and include any applicable taxes. Payment is taken securely by Shopify Payments; we never see or store your full card details.
Your right to change your mind
If you are a consumer buying at a distance, you have a legal right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:
- Services: you have 14 days from the day of the contract. If you asked us to start within that period, you pay for what was provided before you cancelled.
To cancel, email contact@kellykanine.com with your name and order details within the period. A model cancellation form is available from us on request. We refund within 14 days using your original payment method.
If something is wrong (your statutory rights)
If you are a consumer, the Consumer Rights Act 2015 gives you rights that nothing we write here can take away:
- Services must be performed with reasonable care and skill. If they are not, you can ask us to put it right or, where we cannot, for a price reduction.
This is a summary, not a limit on your statutory rights. To make a claim, email contact@kellykanine.com.
Bookings and payment
All bookings must be made through our website. Full payment is required at the time of booking unless otherwise agreed in writing. Where a service involves travel outwith West Lothian, a follow-up invoice for fuel costs (£1.50 per mile) will be issued to your email after booking and must be paid before the booking date. An additional dog from the same household is charged at £10 or £20 per night, depending on the dog. Collections after 12:00pm on the day of departure incur a £15 extended care fee. Please note that double rates apply on several peak holiday dates, including Christmas Eve, Christmas Day, Boxing Day, New Year's Eve and New Year's Day.
Dog care services
By proceeding with a booking, you confirm that your dog meets our requirements. Your dog must be fully vaccinated (proof required), free from contagious illnesses or parasites, and microchipped. Your dog must be able to socialise safely with other dogs, be comfortable with being handled, and must not demonstrate aggression towards humans or other dogs, excessive mounting behaviour, or destructive tendencies. We are unable to accept dogs listed under the Dangerous Dogs Act 1991, dogs covered by the Dangerous Wild Animals Act 1976 (such as wolf hybrids), or dogs subject to a dog control notice under the Control of Dogs (Scotland) Act 2010. We reserve the right to decline or discontinue services if a dog is found to be unsuitable at any time.
Cancellations can be made free of charge up to 48 hours before your scheduled booking, and rescheduling is welcome within the same timeframe, subject to availability. If a cancellation is required within 48 hours of your booking, we may be unable to accommodate a refund; in these circumstances please contact us at contact@kellykanine.com to resolve the matter directly with our team.
You agree to provide accurate information regarding your dog's health, temperament and behaviour, along with any keys or access required to perform the service. While we take the utmost care of every dog in our charge, you acknowledge that any activity involving animals carries inherent risk, and you authorise us to seek veterinary attention on your behalf in the event of an emergency, with any associated costs payable by you.
Our responsibility to you
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to exclude.
If you are a consumer: if we fail to use reasonable care and skill we are responsible for foreseeable loss or damage you suffer as a result. We are not responsible for losses connected to a trade, business or profession, or for loss that was not foreseeable when the contract was made.
Suspension and survival
We may suspend or end your access to the site if you seriously or repeatedly breach these terms. Any parts of these terms that are by nature intended to continue (such as ownership of content and governing law) survive.
Governing law and courts
These terms, and any dispute or claim arising out of them or the site, are governed by the law of Scotland, and the Scottish courts (the Sheriff Court or the Court of Session) have jurisdiction, except that if you are a consumer living in another part of the United Kingdom, you may also bring proceedings in the courts of the part where you live.
